Why the Legal Description is Important

A property's legal description is:


The definition or identity of the real property. The legal description is recorded on the deed, mortgage, title work, listing agreement, purchase agreement, and other legal documents.


The legal description is important because property is conveyed (aka, transferred) via this description, not the address. The legal description is listed on the purchase and listing agreements, so it is crucial that this information is correct. If the legal description is incorrect, you risk incorrectly offering to purchase one plot of land rather than multiple or a completely different property all together. This could also result in listing the incorrect property.


If the property is in a neighborhood, the legal description is likely a combination of the neighborhood name and the development plot number, but the legal description can also consist of measurements and coordinates that define a property.
